Terms & Conditions

1. Definitions

• “Projects Today” refers to the subscription-based project intelligence platform operated by Economic Research India Pvt. Ltd.
• “Client” refers to the individual or organisation subscribing to the Service. “Information” includes all data, dashboards, tenders, BOQs, contacts, and reports provided through the Service.
• By subscribing to the Service, the Client acknowledges and agrees to all terms herein.

2. Nature of Service

• Projects Today provides project, tender and contract intelligence for business enablement. The Service is a data research and information tool and not a guarantee of business outcomes or contracts.
• Projects Today acts solely as an information provider and not as an intermediary, broker, or consultant between the Client and any project stakeholder.

3. Accuracy & Limitation of Liability

• All data is collected using best-effort research and verification methods. Projects Today makes no warranties regarding the accuracy, completeness, or reliability of the Information.
• Projects Today shall not be liable for direct, indirect, incidental, consequential, or special damages arising from the use or inability to use the Service.

4. Fair Usage Policy

• Downloads of Projects, Orders, Tenders, and other data are governed by the fair usage policy specified in the subscription proposal.
• Projects Today reserves the right to hide, restrict, or remove contact numbers of promoters, consultants, or contractors in case of any reservation expressed by the stakeholder.

5. Authorized Use & Restrictions

• Clients may use the data only for their internal business development. The data, reports, or login access cannot be shared, resold, circulated, or passed on outside the Client organisation.
• Any automated scraping, bulk-extraction, or circumvention of system controls will result in immediate termination.
• Projects Today may suspend access if any suspicious or unauthorised activity is detected.

6. Confidentiality & Intellectual Property

• All data, research methodologies, system designs, and formats remain the exclusive property of Projects Today.
• Clients are prohibited from reproducing, reformatting, reverse engineering, or creating derivative works based on the Service or its Information.

7. Data & Contact Usage Disclaimer

• Inclusion of contact or company information does not imply consent for solicitation. The Client is solely responsible for ensuring its outreach complies with privacy, anti-spam, telecommunication, and data protection laws.
• Projects Today shall not be liable for any complaint, legal notice, or dispute arising from the Client’s communications.

8. Service Availability

• Projects Today will take reasonable efforts to ensure uptime but does not guarantee uninterrupted service.
• Temporary maintenance, upgrades, or interruptions shall not constitute a breach of service.

9. Payment, Refund & Cancellation

• Subscription fees are payable in advance and non-refundable.
• Once activated, the subscription cannot be cancelled or paused.
• Refunds shall apply only as required under Indian law in cases of failed or duplicate payment transactions handled by payment gateways.

10. Subscription Term & Termination Limitation

• The subscription is annual, and access begins immediately upon activation.
• Projects Today may restrict, suspend, or terminate access without notice in cases of unauthorised sharing, data scraping, excessive usage, non-payment, or any conduct harmful to its systems or reputation.
• No compensation is payable in such circumstances.

11. Indemnification

• The Client agrees to indemnify and hold harmless Projects Today, its directors, employees, and affiliates from any claims, damages, losses, liabilities, or expenses arising from misuse of the Service or breach of these Terms.

12. Privacy & Data Security

• Projects Today collects Client data solely for operational purposes.
• Payment transactions are processed securely through third-party gateways; no card details are stored.
• While security measures are applied, Projects Today shall not be responsible for any breach beyond its reasonable control.

13. Force Majeure

• Projects Today shall not be liable for delays or failure to perform due to circumstances beyond reasonable control, including system failures, cyber-attacks, power outages, strikes, natural calamities, or government actions.

14. Governing Law

• These Terms shall be governed by the laws of India.

15. Modifications

• Projects Today reserves the right to amend or update these Terms at any time without prior notice.
• Continued use of the Service constitutes acceptance of such changes.

16. Miscellaneous

• Any headings used in this document are for convenience only and shall not affect interpretation of the Terms.

Entire Agreement

• These Terms constitute the entire agreement between Projects Today and the Client and supersede all prior proposals or communications relating to the Service.

Governing Law & Exclusive Jurisdiction

• Subject to the arbitration clause, the courts at Mumbai alone shall have exclusive jurisdiction over all disputes arising from or relating to this Agreement.

Arbitration

• All disputes shall be finally resolved through arbitration under the Arbitration and Conciliation Act, 1996.
• The tribunal shall consist of a sole arbitrator appointed by Projects Today.
• Seat and venue: Mumbai.
• Language: English.
• The award shall be final and binding.

Limitation of Liability Cap

To the maximum extent permitted by applicable law, Projectstoday, its directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, this website, its content, services, or any linked sites.

No Waiver

Failure by Projects Today to enforce any provision does not constitute a waiver of its rights.

Severability

If any provision is held invalid, the remaining provisions shall continue in effect, and the invalid provision shall be replaced with one that reflects its original intent.

Assignment

The Client may not assign or transfer its rights or obligations without prior written consent. Projects Today may assign its rights to affiliates or successors.

Notices

All notices to the Client shall be sent to the registered email address and deemed delivered within 24 hours. Notices to Projects Today shall be sent to help@projectstoday.com with a copy to mktg@projectstoday.com.

Client Responsibility for Credentials

• The Client is solely responsible for securing its login credentials.
• All actions taken through its credentials shall be deemed authorised by the Client.

Compliance With Laws

The Client shall comply with all applicable Indian laws, including telecommunication, anti-spam, data-protection, and privacy regulations.

DPDP Act Compliance

• Clients acknowledge their rights under the Digital Personal Data Protection Act, 2023, including access, correction, withdrawal of consent, and grievance redressal. Data is retained only as required for service delivery.

Audit Rights

• Projects Today reserves the right to audit usage to verify compliance.
• Non-cooperation or detection of violations may result in suspension or termination without liability.

Survival

• Clauses relating to confidentiality, IP, restrictions on use, liability, indemnity, and dispute resolution shall survive termination or expiry of the subscription.

No Partnership or Agency

• Nothing shall be construed as creating a partnership, joint venture, employer-employee, or agency relationship between the Parties.
